VOTE TO WIN: LAZFEED GIVEAWAY

 Terms and Conditions of Participation 

a. These terms and conditions (the “Vote to Win Terms”) govern your participation in Vote To Win: LazFeed Giveaway (“Vote To Win”) provided by Lazada E-Services Philippines, Inc. (“Lazada”) on Lazada’s websites, mobile applications and in-application stores. By participating in Vote To Win, you, as an eligible user ("you" or “User”), agree unconditionally and irrevocably to be bound by, and shall be deemed to accept, these Vote To Win Terms, in addition to Lazada’s Terms of Use, the Platform Engagement Tools Terms and Conditions, the Lazada Wallet Terms and Conditions, the Lazada Wallet Privacy Policy, the Digital Vouchers & Gift Cards Terms and Conditions, and the Privacy Policy, which are incorporated by reference into these Vote To Win Terms. If you do not agree to these Vote To Win Terms, please do not access, participate in Vote To Win. For the avoidance of doubt, capitalized terms used and not defined herein have the same meaning as given to such terms in the Terms of Use.  

1. Voting Period

a. Voting may be done during the voting activity period 

2. General Rules of Participation in the Game 

a. Vote and win prizes!

b. Products will be made available during the Voting Period to be won by Users. Winning Users will win available products for free.

c. Users must vote for products in order to become eligible to win said products. The number of Users selected to win prizes is limited to the quantity of prizes available.

d. Winner(s) of the products are the Users who have the highest Favourite Score and/or highest Intelligence Score, out of all Users who voted for each product, as determined by Lazada.  

e. Users will be issued a Favourite Score based on the number of votes cast during the Voting Period. A User’s Favourite Score will increase based on the number of votes cast for a product. Intelligence Scores are calculated algorithmically based on the following behavioural factors: reviews, purchases, purchases, visit and/or follow store rate, re-visit rate, and social influence. 

f. Users will be issued a fixed number of votes, at Lazada’s discretion, on a daily basis. Users can earn more votes by:

• completing available tasks. Click on the “Get more votes” button located at the bottom of the page to see a list of tasks and the number of corresponding votes to be received for every accomplished task; and 

• completing the check-in task every day.

g. All unused votes shall expire at the end of each calendar day on which said vote was earned.

h. Users are required to pay for shipping and associated logistics costs, as specified in applicable product description pages and checkout pages. 

i. Decisions of Lazada regarding Vote To Win shall be final and unappealable.

3. User’s Obligations 

a. Each User acknowledges and agrees that:  

i. He or she shall comply with all applicable laws and regulations to the fullest extent when participating in Vote To Win;

ii. He or she shall not participate in Vote To Win or permit the participation in the Vote To Win in any manner which may adversely affect other customers' or Users’ participation in Vote To Win or the goodwill or reputation of Lazada;

iii. He or she is responsible for complying with these Vote To Win Terms; 

iv. He/she shall comply with all third-party terms (including, without limitation, any applicable terms of use, policies and guidelines) provided by sharing channels where such sharing channels are used to invite third parties to vote in the Lazada app/website, and shall not, as part of his/her participation, breach any of these terms. By sharing information on any sharing channel, User expressly consents to the sharing of his/her personal data and other information, in accordance with Lazada’s Privacy Policy. User shall be responsible for all information that you communicate, submit, transmit or otherwise make available, whether to Lazada or third parties.and 

v. Lazada, to the fullest extent permitted by law, excludes all warranties, rights and remedies (including warranties implied by statute or otherwise) that a User would otherwise be entitled to under law.  

b. Where Lazada deems or suspects that a User has breached of any of these Vote To Win Terms, including fraudulently participating in Vote To Win, Lazada reserves the right, at its sole and absolute discretion to:  

i. prevent or restrict access of any User to Vote To Win or any of Lazada’s game/contest, the Lazada mobile application, or any of the Lazada Platforms; 

ii. report any activity it suspects to be in violation of any applicable law, statute or regulation to the appropriate authorities and to co-operate with such authorities; and/or 

iii. cancel any order placed as a result of participating in Vote To Win, and charge or claw back from the User any cost or expense incurred in relation to the cancelled order, including shipping fees and associated logistic costs. 

c. Notwithstanding the preceding provision, Lazada reserves the right to take any action against you that it deems necessary, including but not limited to suspension or termination of accounts, without prior notice, where Lazada deems or suspects that any of your actions are abusive, fraudulent, or in breach of your agreement with Lazada.
